Terms of Service – EP – Eduardo Pimenta Watches

These Terms of Service govern purchases made through epwatches.net and your use of the EP Watches online store.

By using the website or placing an order, you agree to these Terms to the extent permitted by applicable law.

Nothing in these Terms excludes or limits mandatory consumer rights.

1. About EP Watches

EP – Eduardo Pimenta Watches is an independent watch brand operating from an atelier in Vuisternens-devant-Romont, Switzerland.

2. Products

We take reasonable care to describe and photograph our products accurately.

Because watches contain physical materials and components, minor differences in colour, texture, surface finish, reflections or strap and bracelet appearance may occur due to lighting, screens, production tolerances and the nature of the materials.

The specifications stated on the relevant product page apply to that model.

3. Assembly in Switzerland

EP Watches currently describes its watches as hand-assembled and individually checked in Switzerland.

This description does not constitute a separate legal “Swiss Made” designation unless a specific product is expressly and lawfully identified as Swiss Made.

4. Movements and Components

Movement, case, crystal, water-resistance rating, dimensions and other specifications vary by model.

Customers should rely on the specifications published on the individual product page rather than assuming that every EP Watches model has identical components or performance.

5. Water Resistance

Water-resistance ratings are model-specific.

A watch described as “diver-style” is not represented as a certified professional diving instrument unless the relevant product page expressly states otherwise.

Water resistance can also be affected over time by wear, seals, impacts, temperature, servicing and improper operation.

Customers should follow the care instructions supplied with the watch and should not operate crowns or pushers underwater unless the specific model is designed and documented for that use.

6. Prices

Prices are displayed in the currency selected or shown by the store and may be changed before an order is placed.

Once an order has been accepted, the price applicable to that order will not be changed except to correct an obvious error where permitted by law and handled appropriately with the customer.

7. Taxes, Customs and Import Charges

Applicable taxes and shipping charges are displayed during checkout where they are collected by EP Watches.

For international orders, the destination country may impose import VAT, customs duties, brokerage costs, handling charges or other taxes or fees.

Unless expressly included at checkout, such charges are normally payable by the customer.

8. Payment

Available payment methods may include major payment cards, PayPal, TWINT, Klarna, cryptocurrency-related payment services, Shop Pay, Apple Pay, Google Pay and other methods shown at checkout.

Not every payment method is necessarily available in every country.

The payment options displayed to you during checkout are authoritative.

An order may be subject to payment authorisation, fraud-prevention checks and other checks required by payment providers or EP Watches.

9. Order Confirmation and Acceptance

After an order is submitted, you may receive an electronic confirmation.

We may contact you if there is a material issue involving payment, suspected fraud, product availability, incorrect pricing, personalisation instructions, shipping restrictions or information required to complete the order.

If we are unable to fulfil an accepted and paid order, the affected amount will be refunded.

10. Made-to-Order Watches

Many EP Watches products are assembled after an order is placed.

Unless otherwise stated, please allow up to 3 weeks for assembly and preparation before dispatch.

If a watch is already in stock and ready for dispatch, it will normally be dispatched within 2–4 business days.

A standard model assembled after purchase is not automatically considered a personalised product solely because it is made or assembled to order.

11. Personalisation and 1/1 Projects

For engraved, individually specified or 1/1 products, the customer is responsible for checking and approving the information supplied for production.

This may include names, dates, initials, text, logos, artwork, colours, layouts and other individual specifications.

Once personalised work has begun, changes or cancellation may no longer be possible.

Mandatory rights relating to defects, non-conformity or errors caused by EP Watches remain unaffected.

12. Shipping

Shipping is governed by our Shipping Policy.

Preparation time and carrier delivery time are separate.

Delivery estimates are not guaranteed dates unless expressly agreed otherwise.

13. Returns and Cancellations

Returns, withdrawals and refunds are governed by our Return & Refund Policy.

Eligible standard products benefit from a 14-day return period after delivery under our policy, subject to the conditions stated there.

Mandatory consumer rights applicable in the customer's country remain unaffected.

14. Warranty

EP Watches currently provides a 3-year international commercial warranty on its watches, subject to the applicable warranty conditions.

The warranty covers eligible manufacturing and assembly defects but does not normally cover accidental damage, misuse, normal wear, unauthorised modifications, incorrect handling, water exposure beyond the model's stated rating or consumable and wear components where the issue results from ordinary use.

The EP Watches commercial warranty is additional to, and does not replace or reduce, mandatory statutory rights.

15. Intellectual Property

Unless otherwise stated, EP Watches owns or lawfully uses the intellectual property associated with its original brand name, logos, photographs, product presentations, designs, written content, graphics and creative materials.

Content from this website may not be copied, reproduced, commercially exploited or presented as another party's work without appropriate authorisation.

16. Third-Party Services

Our store relies on Shopify and other third-party providers for services including payment processing, delivery, reviews, integrations and communications.

Third-party services may be subject to their own terms and privacy policies.

EP Watches is not responsible for the independent operation of third-party websites or services beyond the extent required by applicable law.

17. Website Availability

We aim to maintain the website and its functionality but cannot guarantee uninterrupted or error-free availability at all times.

We may reasonably update the website, correct errors, modify features, carry out maintenance or temporarily suspend functionality where necessary.

18. Liability

Nothing in these Terms excludes or restricts liability that cannot lawfully be excluded or restricted.

To the extent permitted by applicable law, EP Watches is not responsible for indirect or unforeseeable losses resulting solely from circumstances outside our reasonable control.

19. Governing Law

These Terms are governed by Swiss law.

However, this choice of law does not deprive consumers of mandatory protections that apply under the law of their country of residence.

Any mandatory consumer jurisdiction rules remain unaffected.

20. Changes to These Terms

We may update these Terms from time to time.

The version applying to an order is the version in effect when that order was placed, unless applicable law requires otherwise.
